FIFA, the sports international governing body, have announced that there is "no legal foundation" for the case to be referred to them.
There have been calls for the former Arsenal striker to be banned from the game for some time after he appeared to deliberately handle the ball in a World Cup qualifying play-off against the Republic of Ireland.
Some British newspapers referred to the incident as "The Hand of Frog" in reference to an earlier cheat storm involving England and Argentina.
When Argentine play maker Diego Maradona used his hand to score an illegal goal against England in the 1986 World Cup finals he later said he had not cheated but it was "the hand of God".
Henry's handball set up a last gasp winner for William Gallas and means France will participate in this year's tournament in South Africa while Ireland's stars, including Robbie Keane and John O'shea, will have to watch on TV from home.
Blatter, meanwhile, has raised the possibility of awarding "moral compensation" to the Irish team.
"That could be a special trophy or a prize, we'll have to see," he said.

Forget about the technicalities, forget about the beurocracy, this man has cheated a nation out of a World Cup!
Surely in the spirit of the game, he should be punished?!
I can 100% stonewall guarentee you that if it were Robbie Keane doing that, the game would have been replayed, or at least Keane wouldn't have been showing his face in South Africa!
With this in mind, I'm now praying for France to be knocked out in a semi-final by someone diving, or handeling the ball into the net or something, only then I'll truely be able to say that there's justice in the game.
